MicroWay - Training Terms & Conditions

An enrolment for a course is automatically confirmed: 
1. Upon receipt of either a signed Training Registration Form accepting MicroWay’s terms & conditions AND; 
2. Upon receipt of 

a) Payment-in-full no later than 10 working days prior to the start of the course OR; 
b) A purchase order from Approved Corporate Accounts.

Course registration opens at 8:30 am on the first day of the course with courses commencing at 9:00 am.
To minimise disruption to courses, MicroWay reserves the right to refuse entry to a course that has commenced.
MicroWay also reserves the right to ask any person to leave a course if, in MicroWay’s sole discretion, that person is disruptive to the orderly progress of the course.

MicroWay does not guarantee a place on a course until enrolment is confirmed (see above).
With the exception of Approved Corporate Accounts all course fees must be paid-in-full at least 10 working days prior to course commencement.
For Approved Corporate Accounts payment is due 30 days from the date of invoice. Failure to comply with the 30-day credit period will necessitate payment in advance for future training.
MicroWay may apply an administration fee for accounts paid after 30 days of the due date of any invoice. Market rates of interest may be charge on any overdue amounts.

Requests for cancellations must be made in writing and acknowledged by MicroWay. 
The full course fee is charged for all cancellations requested within 10 working days of course commencement.
No refunds will be issued for courses cancelled within 10 working days of course commencement.
Suitably qualified replacements are welcome provided they register prior to the commencement of the first day of the course. 

Requests for transfers must be made in writing and acknowledged by MicroWay.
The transfer of any enrolment requested within 10 working days of the original course commencement will incur a 25% surcharge. 

MicroWay makes every effort to deliver courses on the scheduled dates. However, when necessary, MicroWay reserves the right to, without notice, change course schedules, discontinue courses, modify courses, limit class sizes and refuse entry to a course. 

MicroWay has no liability to the client or any other person for damage, loss or injury (including consequential loss, damage or injury) arising from the service or products provided by MicroWay (except for negligence or wilful acts by MicroWay, its employees or agents) subject to any Terms & Conditions & warranties implied by law which cannot be excluded, limited or modified.

While MicroWay undertakes to have Public Liability insurance, it is the client’s responsibility to ensure adequate workplace related occupational health and safety insurance and other insurance to cover any other employee-related risk while attending training. 

To the extent permitted by law, the liability of MicroWay to the client or any other person either directly or indirectly related arising out of the performance of this agreement is limited to either of the following at MicroWay’s absolute discretion:
1. The supplying of the services &/or product again: OR
2. The payment of the costs of supplying the services &/or product again.

The liability of MicroWay to the client in all other respects (including for negligence or wilful acts by its employees or agents) is limited to the amount the client has paid under this agreement.

Information relating to MicroWay products is believed to be accurate at the time of publication. Such information is however, subject to change without notice. MicroWay is not responsible for inadvertent errors or omissions.
There are no warranties expressed or implied relating to the content or result of attendance and/or completion of a MicroWay course.

It is the responsibility of the organisation/individual making a course enrolment to ensure that the course is appropriate to the needs of the participant. Whilst every care is taken in the preparation of training courses and materials, no warranty is given that the information or advice is relevant to the specific needs of any individual.

MicroWay accepts no responsibility for the loss, theft or damage to any equipment or personal belongings. 

MicroWay retains proprietary rights to all training materials. Training materials are to be used by a single training participant during and after course completion. Any other use is prohibited without the written permission of MicroWay. Course materials may not be on sold or re-used for further training. Additional copies may be available by contacting:

1. If MicroWay considers it relevant to assessing a Client’s application for commercial credit or relevant to collecting overdue payments, the Client agrees that MicroWay may obtain the appropriate credit report from a credit-reporting agency or other such credit organisation. 

2. MicroWay may need to disclose the following information to a credit reporting agency in order to process credit applications and for the ongoing credit management of accounts: 

a) Identifying particulars, including but not limited to Client’s name, current and previous addresses, date of birth, name of current or last known employer, drivers license number, director details, referees, and financial information if applicable; 
b) The fact that the Client has made an application for credit terms with MicroWay; 
c) Payments which are more than 30 days overdue, and for which collection action has commenced; 
d) Where an overdue payment has been previously reported, advise that the invoice is no longer overdue; 
e) Dishonoured cheques drawn by the Client; 
f) Trading history regarding the discharge of amounts due to MicroWay; 
g) Any occurrences of serious trading infringement perpetrated by the Client; and 
h) Any instances where MicroWay ceases to provide service to the Client.
